Using vivianops.com means you have read and agreed to these terms. They cover the marketing website only. Our consulting engagements have a separate contract, which we sign with each client before any work begins.

By accessing or using vivianops.com (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.
The Site and our services
The Site is the marketing presence for VivianOps LLC. Anything you read here is general information about our company, our cybersecurity services, and our consumer software products. Nothing on the Site should be treated as specific security advice for your business. Specific advice is delivered under a signed engagement agreement, which governs that relationship and those deliverables on its own terms.
Intellectual property
All content on this Site — text, layout, code, images, and the VivianOps name and wordmark — is owned by VivianOps LLC, except where credited otherwise. For example, the IBM Plex typefaces are used under the SIL Open Font License.
You may link to the Site. You may quote short passages for review, commentary, or fair-use purposes, with attribution. You may not copy, rehost, republish, or repackage the Site’s content or distinctive visual identity without our written permission.
No warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied — including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We work to keep information on the Site correct and current, but we do not guarantee it is free of errors or continuously available.
Limitation of liability
To the fullest extent permitted by law, VivianOps LLC and its co-founders are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or your inability to use the Site, even if we have been advised of the possibility of such damages.
For services we deliver under a signed engagement agreement, the liability terms of that agreement govern — not these Site terms.
Your conduct on the Site
By using the Site, you agree not to:
- Attempt to gain unauthorized access to the Site, its servers, or any connected system.
- Automate requests at a volume or rate that disrupts service for other visitors.
- Use the Site to distribute malware, illegal content, or anything designed to harm VivianOps or its visitors.
- Misrepresent your affiliation with VivianOps or use our name or marks in a way that implies endorsement we have not given.
If you discover a genuine security issue on the Site, please report it through our Contact page — responsible disclosure is appreciated, not penalized.
Changes to these terms
We may update these Terms. When we do, we will change the “Last updated” date at the top of the page. Continued use of the Site after changes take effect means you accept the updated Terms. Previous versions remain visible in our public repository on GitHub.
Governing law
These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved in the state or federal courts located in Missouri.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be enforced to the extent permissible, and the remaining provisions will remain in full effect.
